Update on Service Animals in public accommodations, employment, transportation and housing

Description

The rules for service animals differ in various settings such as employment, transportation and housing. This session explores the various laws and updates for individuals with disabilities pertaining to service animals in these areas including the 2020 DOT regulations for air travel. Discussions will involve review of legislation, regulations, guidance, case law and recent news items regarding service animals and claimed service animals. During this session participants will learn:

• What businesses, governments, employers, airlines, and housing providers are or are not required to do with regard to service animals.

• What questions a covered entity may ask or require from an individual with a disability.

• What permissible documentation a covered entity may ask or require from an individual with a disability.

Questions for presenters:

1 Since we are accommodating the person and not the animal, would it be permissible to confirm that the person has a disability before continuing with the allowable two questions? “No need for details but could you please confirm with a simple yes or no, are you a person with a disability?” And only ask that of people who do not have an apparent disability.
2 Does the ADA have any guidelines for clients with emotional support animals with regard to public transportation?
