An Update on ADA Drive-by Lawsuits

Wednesday, November 15, 2017

Recent news segments focused on ways in which some consumers and their attorneys misused the ADA in so-called “Drive-by” Lawsuits caused widespread confusion and reaction among the general public. The truth is considerably different than what has been represented by the media, anti-civil rights forces and a legitimately scared but reactionary business community. Attorney J. Aaron McCullough will provide an update so-called ADA"drive-by" lawsuits across the country including some of the more recent media reports on this issue. This webinar will focus on the legal reality behind these lawsuits and also take a look at proposed legal reform and related updates on this issue./p>

Learning objectives for this session include:

  1. Update and review of so-called Drive By Lawsuits and relevant recent case law

  2. A discussion of proposed or pending legal reform on this issue

  3. Understanding how to enforce Title III rights through available remedies and avoid the label of "drive-by" lawsuits

  4. A review of defenses against this type of “drive-by” lawsuit for the business community
